A 30-year-old wanted to sell this black jacket on Tutti.ch – she deliberately did not depict her face.

The black jacket had been hanging untouched in the closet for a long time – that’s why a 30-year-old woman from Aargau decided to sell it on the Tutti.ch classifieds platform. She put on the dress and her boyfriend took some photos, deliberately not to mention her face.

A woman receives a date request

At the beginning of June, a woman from Aargau received an offer. But the so-called “Reto” potential customer seemed less interested in buying the jacket. The guy just made a nasty comment about the woman’s body and started asking for a date.

“I was shocked and not surprised at the same time,” the 30-year-old said for 20 minutes. “I wanted to sell my jacket, not me.” As a woman, she is used to the fact that men sometimes take the right to ignore her privacy. “But Tutti isn’t really a dating application platform,” she continues.

Such incidents are known to Totti

Advertisers in Tutti’s Google reviews also criticize the increase in scammers and obscene statements. A Tutti.ch spokesperson confirmed that they receive “sporadically” messages with similar content.

In most cases, according to Totti, such requests can be prevented through a number of control mechanisms. “If – as in the present case – less obvious messages pass the control mechanisms, they will be removed immediately after notification and verification.” Matching users will then be banned.

Blazer is still waiting for a serious buyer

It is also said that Tutti strives to keep such requests as low as possible and is therefore constantly updating its control mechanisms.

The young woman from Aargau didn’t want to get into an argument. You left the request unanswered and did not report the incident. You haven’t got rid of the jacket yet.

Can I take legal action against these messages?

Dr. Adrian Wyss is a lawyer at the law firm Bratschi.

Viola

“In the Swiss legal system, harassment is not yet punishable,” says lawyer Adrian Weiss. On the other hand, it would be penalized:

  • When someone’s honor is offended by harassment. This may be an offense of defamation.

  • When someone is affected by sexual harassment. However, this requires that “someone be sexually harassed physically or verbally coarsely”. “Extremely vulgar expressions” should be used.

It is also important to consider the social environment and the circumstances in which these statements were made. “There are stricter rules in the workplace than when you have a beer after work,” says Wyss.
