Swisscom files a lawsuit against Sunrise for 90 million francs
Swisscom sued Sunrise for 90 million francs in damages over the mobile sharing agreement.
The lawsuit was filed in January 2023, according to the annual report of Sunrise's parent company Liberty Global. Swisscom claimed breach of a mobile network shared use contract that then-cable network operator UPC, which now belongs to Sunrise, entered into with Swisscom on December 8, 2017. UPC announced on January 8, 2018 that it would switch from Salt to Swisscom for its mobile communications offering.
With Sunrise being acquired by UPC owner Liberty Global, the migration of mobile customers from UPC to Sunrise's mobile network began in mid-2021. With that, Swisscom looked at rock bottom.
Sunrise assumes victory in court
The proceedings are before the Commercial Court in Bern and are still pending, a court spokeswoman said on Wednesday, in response to a request from the AWP news agency. Neither Swisscom nor Sunrise wanted to provide any information because the process is still ongoing, as explained by spokespersons for the two telecommunications companies.
However, parent company Sunrise is not worried: no provisions have been taken as a loss is not considered likely at this stage, Liberty wrote. “We believe the allegations in this lawsuit are baseless and/or exaggerated.” They intend to defend themselves vigorously on this matter.
