The family has to demolish their house – despite the building permit
In Austria, a family lost a lawsuit – with dire consequences. Since part of their house was built on grass land, they will likely have to demolish it again. At that time, the municipality issued a building permit.

In the municipality of Enzenkirchen in northern Austria, a family bought a large property. There is a condominium with swimming pool, double garage, attached garage, storage room and pool house. But the spouses may soon have to demolish everything and flatten it.
The couple bought the property out loud “today” In 2002. Two years later they managed to buy a meadow intended for grassland.
With the building permit from the then mayor in 2004, they finally built the house with attached garage, pool house with pool and garden wall.
“Partially on Grassland”
Residents of another village have now lodged a complaint because the community in question has not taken action against illegal construction for a long time. This also affected the family’s property, as “certain parts of it were moved and partly built on grassland”.
The competent court agreed with the plaintiffs. Now all the buildings will have to be demolished. The family had previously argued unsuccessfully that all distances should be re-measured again. The court responded that the expert was “undoubtedly able to conclude” that parts of the house and double garage were built in grassland.
The court said in a statement that the buildings were “erected in the countryside without consensus.” Therefore, the authority rightfully issued an unconditional disposal order and prohibited the use of facilities. Before demolishing buildings, the family can file a complaint with the Constitutional or Administrative Court. (obf)
