This was announced by the Prosecutor’s Office in Nuremberg on Monday after reviewing the case in the complaints procedure. Accordingly, proceedings against the Czechs remain pending because a criminal offense cannot be proven with a fine.
No evidence of reckless driving
The Stendal Public Prosecutor’s Office dropped the case against the man in June due to a lack of sufficient suspicion. A complaint was lodged against this, which, according to him, was rejected by the Nuremberg Prosecutor’s Office in a decision of August 12. To justify this, she referred to the current state of criminal law in Germany.
According to the prosecutor’s office, speeding on a highway can in principle constitute a criminal offense, but only if other conditions are met. According to the will of the legislature, not only speed records are recorded automatically, even in serious cases. In the present case, there are no relevant indications of evidence of unlawful or reckless driving behavior on the part of the man.
“The fact that a person is moving in a car he is driving at a speed of approximately 116 meters per second may seem very reckless and suicidal, but it does not automatically satisfy the above mentioned criminal offense,” the prosecutor’s office explained. This may be different if you lose control or there is a certain danger on the road. However, this is not relevant to the current case.
The billionaire even took his hands off the wheel
The fact documented in the videos that the driver briefly took his hands off the steering wheel while driving does not change anything in this assessment. For example, the legislation prohibits hands-free driving only for motorcyclists or cyclists. On the other hand, the public prosecutor said that drivers “are not prohibited by law from taking their hands off the wheel.”
In its current version, road traffic regulations for vehicles with a gross weight of up to three and a half tons do not provide for any speed limits on highways. If a federal lawmaker wants to prevent behavior like behavior in this situation, he can consider a change.
