Kansas City Bayer took significant legal risks in 2018 by buying $60 billion from US seed giant Monsanto, which produces the controversial herbicide Roundup that contains glyphosate. The agrochemical and pharmaceutical company has now prevailed in three consecutive glyphosate operations in the United States, but it has also lost three consecutive operations previously. Leverkusen are facing several similar US lawsuits. The US Supreme Court’s decision on admissibility of the case in which Bayer was found guilty in 2019 is expected to be significant to the further development of this major legal construction site. Leverkusen residents hope the Supreme Court will review and overturn the ruling – which will have a signaling effect on many other processes. Recently, however, it did not seem to be the case, the US government advised judges not to accept the case. Should the Supreme Court not want to deal with the glyphosate case or make a final decision against Bayer, the company made an additional $4.5 billion in provisions last summer. The company then plans to use this money to set up a program to handle the claims of potential new plaintiffs in the USA over the next 15 years. According to Bayer, Roundup is safe when used as directed.
